1. Are property owners responsible for clearing ice & snow from sidewalks?

Yes! Pursuant to the City Code, sidewalks need to be free from snow and ice for the full paved width of such sidewalk, 24 hours after the beginning of a snowfall. For properties that abut the intersection of two streets, the sidewalks shall include that portion of the sidewalk that runs to the curbline of any street and shall include any access ramps therein.

When snow and ice on any sidewalk is frozen so hard that it cannot be removed without injury to the sidewalk, it needs to be strewn and kept strewn with ashes, sand, sawdust or other suitable material, so as to be no longer dangerous to life and limb. As soon as practical thereafter, the sidewalk shall be completely cleared of snow, ice and other materials strewn thereon.

Whenever any sidewalk is not kept free from snow and ice as defined in the City Code, the Superintendent of Public Works or his or her designee may clear the sidewalk so that it is free from snow and ice and shall notify the City Chamberlain of the expense incurred by the amount of labor equipment and materials used. The minimum charge shall be $50. The City Chamberlain shall promptly bill the owner of that property for services rendered.

2. Who do I call if shrubs and bushes grow over sidewalks?

You can call the Ithaca Building Division at (607) 274-6508 and ask them to investigate a violation of the Exterior Property Code. The City Code mandates that trees, shrubs or other vegetation be pruned so that they will not obstruct the passage of pedestrians on sidewalks. The maintenance of City trees, including trees between the sidewalk and curb, must be left to the Department of Public Works.

3. Is it legal to park your car in a way that blocks the sidewalk?

No! Section 1202 of the New York State Vehicle and Traffic Law prohibits parking on a sidewalk or crosswalk. That includes parking in a driveway that blocks pedestrian access to a sidewalk. These regulations apply regardless of ongoing activities such as special events and construction sites. 4. Are stores and restaurants allowed to block sidewalks with signs and tables?

Restaurants are allowed to have outdoor dining tables if they have obtained a permit from the Superintendent of Public Works Office. Their signs are required to be located within their allotted dining area. Permit holders are required to maintain a 5ft width of unobstructed sidewalks in front of their business to remain compliant with the American with Disabilities Act (ADA). Most areas will have sidewalk markings and tables, chairs, and signs must be located within those markings. Please call the Superintendent's Office at (607) 274-6527 to report any restaurants that are not complying with the requirements of their permits.

Certain areas around the Ithaca Commons are allowed to place signs, planters, and merchandise in front of their storefronts. City Code dictates how many, how large, and where these items can be placed. A five foot section of unobstructed sidewalk must be maintained for pedestrian access. 5. What are the responsibilities of event planners to make sure events are accessible?

Ithaca is home to many special events both large and small in size and scope. For large scale events that occur on public property, event planners are required to submit accessibility plans that address access to event features (booths, entertainment, etc.), parking, and restroom facilities. Event planners are not allowed to block access to sidewalks unless they provide another accessible avenue that allows people to access stores, restaurants, etc. Event planners are required to advertise contact information that people can use if they have questions, need special accommodations, or would like to file a complaint.

6. Can contractors block sidewalks during construction projects?

Yes, contractors can obtain a permit to do work on sidewalks, driveways, and in the street right-away. Permits are issued by the Engineering Office and more information can be found below. Contractors are encouraged to provide pedestrian detours, assist people who may need it, and leave their work zones in a safe condition during non-working hours. 7. What is the Mobility, Accessibility and Transportation Commission?

The Mobility, Accessibility and Transportation Commission is a group of volunteer citizens that assess all modes of transportation in the City.  They work to identify, educate, and advise Common Council and city staff on issues that present obstacles to equal rights, access, and privileges for persons with disabilities. The Commission meets on the fourth Monday of each month at 6:00 pm in Common Council Chambers, 3rd floor, City Hall, 108 E. Green Street.  Everyone is welcome to attend and public comment at the beginning of the meeting is welcomed.
